Terms of Use— Examen

These Terms of Use (“Terms”) govern the access and use of the Examen application (“App”), made available by Lumina Digital (“we”, “Controller”). By downloading, accessing, or using the App, you (“User”) declare that you have read, understood, and agree to these Terms. If you do not agree, do not use the App.
1. Object and Purpose of the App
1.1. Examen is a devotional and pedagogical resource intended to assist the User in the examination of conscience and personal preparation for Confession.
1.2. The App may contain texts, scripts, questions, prayers, and personal organization features (e.g., review and final list) for the purpose of spiritual support.
2. Important: Spiritual Nature and Disclaimers
2.1. Examen does not replace the Sacrament of Penance/Confession celebrated in person with a validly ordained priest, nor does it replace spiritual direction, pastoral counseling, or individual religious guidance.
2.2. Any excerpts related to the rite (for example, traditional formulas) are for informational and supportive purposes only and do not, in themselves, produce sacramental effects.
2.3. Use of the App is the User's responsibility, who acknowledges that contents and guides are auxiliary and may not suit all personal situations.
3. Eligibility and Use by Minors
3.1. The App may offer adapted reading profiles.
3.2. We recommend that use by children and adolescents be supervised by legal guardians, according to their maturity and family guidelines.
4. Account, Offline Functionality, and Local Data
4.1. The App can be used without creating an account, depending on the available features.
4.2. Examen was designed to function mostly offline, with data stored on the User's device.
4.3. The User acknowledges that, as this involves local data, events such as uninstallation, device change, hardware failure, loss of device, system restoration, or formatting may result in the irreversible loss of data stored on the device.
5. Premium Subscriptions, Billing, and Restoration
5.1. The App may offer free features and Premium features through a subscription.
5.2. Payment Processing: Subscriptions are processed exclusively by the Apple App Store (iOS) and/or the Google Play Store (Android), depending on the User's platform.
5.3. Auto-Renewal: When applicable, the subscription may renew automatically unless cancelled within the timeframe defined by the store (generally up to 24 hours before the end of the current period).
5.4. Management and Cancellation: Administration of the subscription (cancellation, reactivation, plan changes) must be done in the User's account settings within the respective store. Deleting the App does not cancel the subscription.
5.5. Restoration: Premium restoration is linked to the User's store account (Apple ID or Google Account) and may not be transferable between platforms (e.g., from iOS to Android).
5.6. Refunds: Refund requests are governed by the store's policies (Apple/Google). We do not control the refund process but can guide the User on where to request it.
6. License to Use
6.1. We grant the User a limited, revocable, non-transferable, non-exclusive license, without the right to sublicense, to install and use the App for personal purposes, in compliance with these Terms.
6.2. The User is prohibited from: (i) copying, modifying, adapting, translating, or creating derivative works of the App; (ii) reverse engineering, decompiling, or attempting to extract the source code, unless permitted by law; (iii) commercially exploiting the App without authorization; (iv) using the App in an unlawful manner.
7. Intellectual Property
7.1. The App, including its interface, design, brand, logos, texts, scripts, selection and organization of content, and the source code, is the property of Lumina Digital or its licensors and is protected by applicable legislation.
7.2. Use of the App does not grant the User any intellectual property rights beyond the limited license provided in these Terms.
8. User Conduct and Proper Use
8.1. The User agrees to use the App in a lawful manner and in compliance with these Terms.
8.2. It is prohibited to use the App for illegal or fraudulent purposes, to violate the rights of third parties, or to attempt to compromise the security/stability of the App.
9. Availability, Updates, and Changes
9.1. We may, at our discretion, update, modify, suspend, or discontinue App features, including free and Premium resources, for technical, security, or product evolution reasons.
9.2. Unavailability may occur due to factors beyond our control (e.g., operating system failures, app store issues, network problems, third-party services).
10. Disclaimer of Warranties
10.1. The App is provided “as is” and “as available,” without express or implied warranties, to the maximum extent permitted by law.
11. Limitation of Liability
11.1. To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential damages, loss of profits, or loss of data arising from the use or inability to use the App.
11.2. In any event, any liability shall be limited to the amount actually paid by the User for the Premium subscription in the 12 months preceding the event that gave rise to the claim, where applicable and permitted by law.
12. Privacy Policy
12.1. The handling of information related to the App is described in the Examen Privacy Policy, which is integrated into these Terms by reference.
13. Changes to these Terms
13.1. We may update these Terms periodically. The current version will indicate the “Last updated” date.
13.2. Continued use of the App after the publication of changes constitutes acceptance of the updated Terms.
14. Governing Law and Jurisdiction
14.1. These Terms are governed by the laws of the Federative Republic of Brazil.
14.2. The jurisdiction of the city of Brasília/DF is elected, waiving any other, however privileged, to resolve controversies arising from these Terms, unless otherwise provided by law.
